Welcome to GameNile™. The terms "GameNile," "we," "us," and "our" refer to GameNile and the entity operating GameNile.com.

GameNile operates this website and online store, including all related information, content, features, tools, products, and services, in order to provide customers with a curated shopping experience (collectively, the "Services").

GameNile is powered by Shopify, which provides the ecommerce platform that enables us to provide the Services.

These Terms of Service, together with any policies referenced in them (collectively, the "Terms"), describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information concerning your legal rights and responsibilities, including limitations of liability, intellectual-property restrictions, restrictions on automated access and data extraction, and other conditions governing your use of the Services.

By visiting, browsing, interacting with, purchasing from, creating an account on, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy.

We reserve the right to refuse service, restrict access, suspend accounts, or terminate accounts where permitted by law, including where we reasonably believe an account has been used fraudulently, unlawfully, abusively, or in violation of these Terms.

SECTION 2 — OUR PRODUCTS

GameNile primarily sells video games, consoles, accessories, collectibles, electronics, and related products, including pre-owned and refurbished products.

We make reasonable efforts to accurately represent the products offered through the Services. However, product appearance may vary depending on your display, device, brightness, color settings, or other technical factors.

For pre-owned products, normal variations in cosmetic condition may occur. Unless a listing expressly states that the exact photographed item will be received, photographs may in some circumstances be representative of the product, product type, or condition category being offered.

Descriptions, specifications, compatibility information, photographs, prices, availability, condition information, and other product information may be updated or corrected at any time.

We reserve the right to discontinue a product, correct information, limit available quantities, or restrict sales to particular persons, geographic regions, jurisdictions, or customers where permitted by law.

Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.

SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase the products in that order.

GameNile reserves the right to accept, decline, limit, or cancel an order where permitted by law, including in cases involving suspected fraud, pricing errors, inventory discrepancies, payment issues, unusually large quantities, resale activity, abuse of promotional offers, or other circumstances that reasonably justify cancellation.

An order is not accepted until GameNile confirms acceptance and applicable payment processing has been completed.

Please review your order carefully before submitting it. Once processing has begun, we may be unable to accommodate cancellation or modification requests.

If we cancel or materially modify an order, we will make reasonable efforts to notify you using the contact information provided with the order.

Purchases are also subject to our Refund Policy, Shipping Policy, and any applicable warranty or refurbishment policy posted on the Services.

Purchases made through GameNile are intended for lawful personal, household, business, collection, or resale purposes. However, purchasing a GameNile product does not transfer any rights in GameNile photographs, website content, product descriptions, catalog data, branding, or other GameNile Content.

SECTION 4 — PRICES, PROMOTIONS, AND BILLING

Prices, discounts, promotions, shipping offers, and product availability may change without notice.

Unless otherwise stated, the price charged for a product will be the price displayed and confirmed during checkout at the time the order is submitted.

Posted prices may not include applicable taxes, shipping, handling, customs duties, import charges, or similar charges unless expressly stated.

Prices offered through GameNile.com may differ from prices offered through third-party marketplaces, physical locations, promotional campaigns, seller marketplaces, or other channels.

Promotional offers may be subject to additional terms and conditions. If specific promotional terms conflict with these Terms with respect to that promotion, the promotional terms will control.

You agree to provide accurate and current purchase, payment, billing, and contact information.

You represent and warrant that you are authorized to use any payment method submitted through the Services and that charges properly incurred through that payment method will be honored.

SECTION 5 — SHIPPING AND DELIVERY

Shipping and delivery estimates are estimates only unless we expressly state otherwise.

GameNile is not responsible for delays caused by carriers, weather, customs processing, incorrect addresses supplied by customers, transportation disruptions, natural disasters, labor disruptions, governmental actions, or other circumstances beyond our reasonable control.

Risk of loss and responsibility for shipped products will be determined in accordance with applicable law and the terms of the carrier and payment method involved.

Additional shipping terms, processing times, free-shipping thresholds, expedited-shipping options, and delivery policies may be stated in our Shipping Policy.

SECTION 6 — INTELLECTUAL PROPERTY, PRODUCT PHOTOGRAPHY, AND CATALOG CONTENT

6.1 GameNile Content

Except for third-party content and intellectual property identified below, the Services and original content created by or for GameNile are owned by GameNile, JIMBOSGAMES LLC, or their licensors to the extent protected by applicable law.

This may include original product photography, original written descriptions, graphics, videos, layouts, visual presentation, data annotations, classifications, editorial selections, organization, arrangement, branding, logos, software, interfaces, and other materials created by or for GameNile (collectively, "GameNile Content").

GameNile Content may be protected by copyright, trademark, trade-dress, database, unfair-competition, contract, and other applicable laws.

Nothing in these Terms transfers ownership of GameNile Content to you.

Except for the limited rights expressly provided in these Terms, all rights are reserved.

6.2 Product Photography

Product photographs created by or for GameNile are GameNile Content and are owned by GameNile, JIMBOSGAMES LLC, or their licensors to the extent protected by applicable law.

The absence of a watermark, copyright notice, visible logo, embedded metadata, or other ownership marking does not place a photograph in the public domain and does not grant permission for commercial use.

Individual customers may download, save, screenshot, or otherwise retain a reasonable number of GameNile product photographs for their own personal, non-commercial use.

For example, a customer may save a photograph for personal reference, to identify a product, to maintain a personal collection record, or to share privately with another individual.

This limited permission does not authorize republication, commercial exploitation, systematic downloading, redistribution, or incorporation into another commercial service.

Without GameNile's prior written permission, GameNile product photographs may not be used on another commercial website, ecommerce store, marketplace listing, auction listing, advertisement, product catalog, promotional service, commercial social-media listing, or other commercial-facing publication.

GameNile product photographs may not be used to advertise, represent, describe, or facilitate the sale of products offered by another seller or business.

GameNile photographs also may not be systematically collected, copied, downloaded, harvested, archived, or incorporated into an image database, commercial dataset, catalog, marketplace, price guide, machine-learning dataset, artificial-intelligence training set, computer-vision dataset, or similar collection without prior written authorization.

6.3 Written Content

Original descriptions, editorial material, guides, policies, educational content, condition explanations, refurbishment information, service descriptions, and other original text created by or for GameNile constitute GameNile Content to the extent protected by applicable law.

You may quote limited portions of GameNile Content for legitimate commentary, criticism, news reporting, research, or other uses permitted by applicable law.

You may not systematically copy, reproduce, republish, redistribute, or commercially exploit GameNile's original written content without our prior written permission.

6.4 Catalog and Factual Product Information

The GameNile catalog contains both original GameNile Content and factual information concerning video games and related products.

Factual information may include game titles, platforms, release dates, product identifiers, developers, publishers, genres, player counts, compatibility information, ratings, product model numbers, and similar facts.

GameNile does not claim copyright ownership over individual facts that are not protected by copyright law.

However, your access to and use of the Services remains subject to these Terms.

You may use information displayed through the Services for normal shopping, personal reference, comparison, collection management, and other ordinary individual purposes.

You may not systematically extract, collect, reproduce, aggregate, compile, republish, or commercially exploit substantial portions of the GameNile catalog through use of the Services.

You may not use GameNile as a source from which to construct, populate, maintain, update, or enhance another commercial marketplace, online store, product database, price guide, comparison service, data brokerage service, artificial-intelligence system, commercial catalog, or similar service without our prior written permission.

These contractual restrictions apply regardless of whether particular individual facts would independently qualify for copyright protection.

6.5 Third-Party Reference Sources

In developing and maintaining its product catalog, GameNileeNile may consult publicly available information, manufacturer materials, product documentation, industry reference sources, and third-party databases.

TheGamesDB has been used as one of several supplemental reference sources for certain factual video game information during the development of the GameNile catalog.

This reference does not mean that the GameNile catalog is owned by, operated by, sponsored by, endorsed by, or wholly derived from TheGamesDB.

GameNile does not claim ownership of third-party trademarks, copyrighted artwork, game content, packaging artwork, logos, character designs, screenshots, manufacturer materials, or other intellectual property belonging to publishers, developers, manufacturers, data providers, or other third parties.

References to third-party products, companies, trademarks, or data sources are provided for identification, attribution, compatibility information, research, or informational purposes and do not imply sponsorship, endorsement, affiliation, or partnership unless expressly stated.

6.6 Video Game and Manufacturer Intellectual Property

Video game titles, console names, manufacturer names, publisher names, developer names, characters, logos, packaging artwork, screenshots, and other third-party intellectual property displayed through the Services remain the property of their respective owners.

Such materials may appear in product photography or product-identification information because they form part of the physical products being offered for sale or are necessary to identify those products.

GameNile's ownership of a photograph of a physical product does not imply ownership of trademarks, copyrighted artwork, characters, or other intellectual property depicted on that product.

6.7 GAMENILE Trademark

GAMENILE™ is a trademark owned by JIMBOSGAMES LLC.

The GAMENILE name, GameNile™ branding, logos, service names, designs, slogans, and other source identifiers used in connection with GameNile are trademarks, service marks, or trade dress owned by JIMBOSGAMES LLC or used by GameNile with authorization from JIMBOSGAMES LLC.

You may not use the GAMENILE trademark, GameNile name, GameNile logos, or other GameNile branding in a manner that is likely to cause confusion as to source, sponsorship, endorsement, affiliation, or authorization without prior written permission from JIMBOSGAMES LLC.

Nothing in these Terms grants any license or right to use the GAMENILE trademark or other GameNile branding except as expressly authorized in writing.

All third-party trademarks remain the property of their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to features, applications, integrations, or tools provided by third parties.

Unless expressly stated otherwise, we do not control those third-party tools and may provide access to them on an "as is" and "as available" basis.

Your use of third-party tools may be subject to separate terms, conditions, privacy policies, fees, or requirements imposed by the applicable provider.

You are responsible for reviewing and complying with those terms.

We may introduce additional tools, services, resources, or functionality in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS AND SERVICES

The Services may contain links to, integrations with, or materials provided by third parties.

We are not responsible for examining or evaluating the content, accuracy, security, availability, legality, products, services, practices, or policies of third-party websites or services.

If you leave the Services or interact with a third-party service, you do so subject to that third party's terms and policies.

GameNile is not responsible for losses or damages arising from third-party websites, products, services, content, or transactions except to the extent required by applicable law.

Questions or disputes concerning third-party products or services should ordinarily be directed to the relevant third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

GameNile is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with GameNile.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and GameNile, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with GameNile to the extent permitted by applicable law.

SECTION 10 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy, available at:

Certain information may also be collected or processed by Shopify in connection with providing the ecommerce platform and related services.

Because the Services are hosted through Shopify and may use third-party service providers, information you submit may be transmitted to or processed by Shopify and other service providers in the United States or other jurisdictions.

Please review our Privacy Policy for additional information concerning how GameNile collects, uses, discloses, and protects personal information.

SECTION 11 — REVIEWS, FEEDBACK, AND USER SUBMISSIONS

If you submit reviews, comments, photographs, suggestions, ideas, feedback, proposals, recommendations, or other content to GameNile ("User Content"), you retain ownership of any rights you otherwise hold in that content.

By submitting User Content through the Services or directly to GameNile for publication, you grant GameNile a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, reproduce, display, publish, distribute, adapt, format, and otherwise use that User Content in connection with operating, improving, advertising, and promoting GameNile and the Services.

You represent and warrant that you own or control the necessary rights to submit the User Content and grant the license described above.

You may not submit content that infringes the rights of others, is fraudulent or misleading, contains malicious software, violates applicable law, unlawfully discloses personal information, or is otherwise prohibited by these Terms.

We may monitor, edit, refuse, or remove User Content where permitted by law, but we are not obligated to do so.

GameNile is not responsible for User Content submitted by third parties except to the extent required by applicable law.

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS

Information displayed through the Services may occasionally contain typographical errors, incorrect specifications, pricing errors, inventory inaccuracies, outdated information, technical errors, or omissions.

We reserve the right to correct errors, inaccuracies, or omissions and to update information at any time without prior notice.

Where permitted by applicable law, we may also cancel or modify an order affected by a material pricing, inventory, or listing error.

If an order is canceled after payment because of such an error, we will refund amounts paid for the canceled portion of the order.

SECTION 13 — PROHIBITED USES

You may access and use the Services only for lawful purposes and in accordance with these Terms.

You may not use the Services to violate applicable law, infringe intellectual-property or privacy rights, commit fraud, transmit malicious software, interfere with another person's use of the Services, impersonate another person or entity, send unauthorized spam or solicitations, obtain unauthorized access to accounts or systems, or engage in conduct reasonably likely to harm GameNile, Shopify, our customers, our service providers, or other persons.

You also may not reproduce, duplicate, sell, resell, commercially exploit, systematically extract, or otherwise misuse the Services or GameNile Content except as expressly authorized in these Terms.

13.1 Automated Access and Scraping

Except where expressly authorized by GameNile, you may not directly or indirectly use automated or systematic means to scrape, crawl, harvest, mine, download, index, copy, extract, collect, monitor, or reproduce substantial portions of the Services or GameNile Content.

Prohibited technologies and methods include robots, spiders, crawlers, automated browser tools, headless browsers, scripts, scraping applications, data-extraction systems, artificial-intelligence agents, autonomous agents, browser automation, computer-vision extraction systems, or substantially similar technologies when used for prohibited collection or extraction.

Ordinary use of a conventional web browser by an individual customer is not prohibited.

Accessibility tools, screen readers, browser accessibility functions, password managers, ordinary browser caching, and other tools used primarily to enable individual access to the Services are also not prohibited.

13.2 Circumvention

You may not bypass, evade, defeat, disable, interfere with, or circumvent technical measures intended to regulate access to the Services.

This includes attempting to evade rate limits, CAPTCHAs, robot-exclusion instructions, authentication requirements, access controls, traffic restrictions, bot-detection systems, security controls, or other technical protections.

You may not distribute automated activity among multiple IP addresses, proxy servers, virtual private networks, devices, accounts, identities, browser fingerprints, user-agent strings, cloud services, or other resources for the purpose of avoiding access restrictions or concealing prohibited automated activity.

13.3 Commercial Data Harvesting

Without our prior written permission, you may not use GameNile Content as a source for systematically building or maintaining another commercial website, marketplace, ecommerce catalog, pricing database, game database, image archive, product-research service, commercial data feed, comparison engine, reseller tool, artificial-intelligence dataset, or substantially similar product or service.

The fact that information can technically be viewed through a public webpage, network request, browser developer tool, publicly reachable endpoint, structured-data field, JavaScript object, page source, or other client-accessible resource does not constitute permission for prohibited bulk collection or commercial reuse.

13.4 Artificial Intelligence and Machine Learning

Except with GameNile's prior written permission, GameNile Content may not be systematically collected or used to train, fine-tune, augment, ground, benchmark, evaluate, validate, or develop an artificial-intelligence system, machine-learning system, computer-vision system, generative model, foundation model, large language model, retrieval system, commercial recommendation model, or similar technology.

This restriction does not prohibit an individual customer from using generally available consumer tools for ordinary personal purposes involving a limited amount of GameNile Content, provided that use does not result in commercial republication, systematic extraction, creation of a competing dataset, or other prohibited activity.

13.5 Search Engines

Nothing in this Section is intended to prohibit legitimate general-purpose public search engines from indexing portions of the Services where such indexing complies with our robots.txt directives, published crawler instructions, technical restrictions, and other applicable access requirements.

GameNile may modify crawler permissions at any time.

13.6 Enforcement

We reserve the right to investigate suspected violations of these Terms and to restrict, rate-limit, challenge, block, suspend, or terminate access by a user, account, device, network, automated system, or service where we reasonably believe a violation has occurred or where activity creates an unreasonable burden or security risk.

We may also preserve relevant records and pursue remedies available under contract, intellectual-property law, computer-security law, or other applicable law.

SECTION 14 — AUTOMATED AGENTS

For purposes of this section, an "Agent" means software or a service that acts autonomously or semi-autonomously on behalf of a person or organization.

An Agent may access or interact with the Services only where such access is expressly authorized by GameNile, permitted under these Terms, or permitted by applicable technical instructions published by GameNile.

Authorization to access the Services does not itself authorize copying, redistribution, commercial exploitation, bulk extraction, AI training, creation of a competing database, or other reuse of GameNile Content.

Where GameNile permits automated Agent access, the Agent must comply with applicable rate limits, robots.txt directives, authentication requirements, technical restrictions, identification requirements, and other instructions.

An Agent may not conceal or misrepresent automated activity for the purpose of circumventing restrictions.

An Agent may not solve, bypass, outsource, or otherwise circumvent mechanisms intended to distinguish automated activity from human activity where doing so would violate these Terms or defeat a technical access restriction.

We may limit or revoke automated access at any time.

SECTION 15 — TERMINATION AND RESTRICTION OF ACCESS

We may suspend, restrict, or terminate your access to all or part of the Services where permitted by law, including if we reasonably determine that you have violated these Terms, engaged in fraudulent or abusive activity, created security risks, infringed another person's rights, or engaged in prohibited scraping or automated access.

Termination does not eliminate obligations or liabilities arising before termination.

Sections concerning intellectual property, prohibited uses, automated access, limitations of liability, indemnification, dispute-related provisions, governing law, and other provisions that by their nature should survive termination will continue to apply.

SECTION 16 — DISCLAIMER OF WARRANTIES

Information made available through the Services is provided for general shopping, informational, and reference purposes.

Although we make reasonable efforts to provide accurate information, we do not warrant that every description, specification, compatibility statement, release date, product detail, price, inventory quantity, photograph, or other informational field will always be complete, current, or error-free.

Except for warranties expressly provided by GameNile and rights that cannot legally be excluded, the Services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, GameNile disclaims warranties and conditions not expressly stated by us, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, title, and non-infringement.

We do not warrant that access to the Services will always be uninterrupted, secure, timely, or error-free.

Nothing in this section eliminates any express warranty offered by GameNile, including any separately stated standard or refurbished-product warranty, or any consumer protection that cannot legally be waived.

Some jurisdictions do not permit certain exclusions or limitations of warranties, in which case portions of this section may not apply to you.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAMENILE, JIMBOSGAMES LLC, AND THEIR RESPECTIVE OWNERS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST BUSINESS OPPORTUNITY, LOSS OF DATA, OR REPLACEMENT COSTS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER A CLAIM IS BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANOTHER LEGAL THEORY AND REGARDLESS OF WHETHER THE POSSIBILITY OF SUCH DAMAGES WAS DISCLOSED.

TO THE EXTENT PERMITTED BY LAW, GAMENILE AND JIMBOSGAMES LLC WILL NOT BE LIABLE FOR LOSSES CAUSED BY THIRD-PARTY SERVICES, CARRIER DELAYS, INTERRUPTIONS OUTSIDE OUR REASONABLE CONTROL, UNAUTHORIZED ACCESS NOT CAUSED BY OUR FAILURE TO COMPLY WITH APPLICABLE LAW, OR RELIANCE UPON INFORMATION THAT THESE TERMS EXPRESSLY IDENTIFY AS SUBJECT TO ERROR OR CHANGE.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Some jurisdictions do not permit certain limitations of liability, so some of these limitations may not apply to you.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless GameNile, JIMBOSGAMES LLC, Shopify, and our respective affiliates, owners, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, judgments, costs, and reasonable attorneys' fees arising from your material violation of these Terms, your violation of applicable law, your infringement of another person's rights, or your misuse of the Services.

We will provide reasonable notice of an indemnifiable claim.

We may control the defense and settlement of a claim subject to this section, provided that we will not agree to a settlement imposing non-monetary obligations on you without your consent where your consent is legally required.

You agree to reasonably cooperate with the defense of an indemnified claim.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where necessary, severed from these Terms.

The remaining provisions will remain in full force and effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies and additional terms expressly incorporated by reference, constitute the agreement between you and GameNile concerning use of the Services and supersede prior agreements concerning the same subject matter, except where a separate written agreement expressly provides otherwise.

Any ambiguity in these Terms will be interpreted in accordance with applicable law.

SECTION 21 — ASSIGNMENT

You may not assign, delegate, or transfer your rights or obligations under these Terms without our prior written consent where such restriction is permitted by law.

GameNile or JIMBOSGAMES LLC may assign or transfer these Terms, or rights and obligations under them, in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, transfer of the business, or similar transaction, subject to applicable law.

SECTION 22 — GOVERNING LAW AND VENUE

These Terms and disputes arising from or relating to the Services will be governed by the laws applicable in the jurisdiction where GameNile is headquartered, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Subject to any rights that cannot lawfully be waived, you and GameNile consent to personal jurisdiction and venue in the applicable state and federal courts serving the jurisdiction where GameNile is headquartered.

Nothing in this section deprives a consumer of protections or remedies that cannot lawfully be waived under the laws applicable to that consumer.

SECTION 23 — HEADINGS

Section headings are provided for convenience and organization only and do not alter the meaning or interpretation of these Terms.

SECTION 24 — CHANGES TO THESE TERMS

The most current version of these Terms will be available through the Services.

We may update or replace portions of these Terms from time to time.

Where required by applicable law, we will provide notice of material changes.

Changes will become effective on the date stated in the updated Terms or applicable notice.
